Creditors who face issues with unreliable contractors are confronted with a difficult choice – how to recover their money? The variety of offers from debt collection companies, attorneys, and legal advisors often leaves individuals unfamiliar with debt recovery unsure of what to do. Therefore, in the following sentences, we will explain the essence of debt recovery.

Debt recovery involves reaching an agreement with the debtor, leading to a settlement and debt repayment without the need to file a lawsuit for payment in court. In today’s realities, this is not an easy task, which is why it’s worth trusting professionals.

Since 2011, we have been comprehensively handling the legal process of debt recovery. Our offer is directed at creditors, i.e., individuals to whom debtors owe money. Why “should they”? Unfortunately, they don’t always have to, which has resulted in a significant number of aggrieved creditors.

We openly admit that we do not achieve 100% success in debt collection, a popular marketing claim of many debt collection agencies. The current regulations are outright disastrous for creditors. The liberalization of consumer bankruptcy laws, debtor restructuring, the shortening of limitation periods for claims, and changes to the Act on Court Bailiffs are just some of the recent legislative changes that have effectively allowed debtors to legally avoid paying creditors.

In cases of unsuccessful debt recovery, it is worth considering further legal actions, such as filing a lawsuit for payment or submitting a notification to the prosecutor’s office on suspicion of a criminal offense. This is the task of our attorneys or legal advisors. In such cases, we operate on dual fronts: both through debt collection efforts and legal or criminal proceedings.

The role of detectives in the debt recovery process is invaluable. Detectives can identify the debtor’s assets, such as real estate and vehicles owned or co-owned by the debtor, not only in Poland but also abroad. Additionally, they can trace transferred assets up to five years back, which is crucial in the context of Paulian claims. According to the Act on Detective Services, detectives can also observe debtors or so-called “silent partners” to gather evidence for notifications submitted to the prosecutor’s office or uncover transferred assets. Detectives also handle the task of determining current addresses of the debtor, which is vital for ensuring proper delivery of correspondence.

In cases involving highly complex factual circumstances and larger debt amounts, the ability to integrate the cooperation of all three departments within one firm is highly desirable. This approach saves time and costs for the creditor. It is also convenient for creditors who are public figures or in cases involving highly sensitive matters, as clients do not have to repeatedly disclose their issues to different representatives.

Throughout the entire debt recovery process, we ensure that creditors have direct contact with our legal advisors and the individual handling their case. Without the express consent of our client, we do not undertake any actions. You are the decision-makers, and we act solely as your representatives. The account provided to debtors for payment is your bank account, not ours, which ensures transparency regarding payments made by debtors.
